What is TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law that protects you from unwanted calls and texts. Companies that violate it owe you money — and most people don't know this.

  • Robocalls — Pre-recorded messages to your cell = illegal without consent
  • Autodialers — Calls using automated systems = illegal without consent
  • Spam texts — Marketing SMS without permission = illegal

Register on Do Not Call List

This is required. Being on the National Do Not Call Registry gives you legal standing to sue telemarketers. It's free and takes 2 minutes.

Once registered, companies have 31 days to stop calling you. After that, every call is a violation.

Collect Evidence (Critical)

Your evidence makes or breaks the case. Here's exactly what you need:

Required Evidence:

  • Screenshot of call log — showing the number, date, and time
  • Screenshot of texts — the full conversation including their number
  • Voicemails — save/download these immediately, don't let them expire
  • Phone bill statement — shows the call happened on your line

Best Evidence (Stronger Case):

  • Call recordings — USE A CALL RECORDER APP. Record every spam call. Check if your state is one-party consent (most are).
  • Company name from recording — Let the robocall play, they usually say who they are
  • Callback number — If they give one, write it down
  • Agent name — If you talk to a person, ask their name

Pro Tip: When you answer, DON'T say "hello." Just stay silent for 2-3 seconds. Robocalls auto-detect voice and start playing. You'll catch the full recording from the beginning. Then press 1 to talk to a human and get the company name.

One-party consent states (you can record without telling them): most states including FL, TX, NY, GA, OH, AZ, and 32 others. Two-party states (must inform): CA, WA, MA, IL, PA, and a few others.

The Script (What to Say):

Key Info You Need:

  • Company name (exact legal name if possible)
  • Callback number
  • City/State they're in
  • How they got your number
  • What they're selling

Don't: Get angry, threaten to sue, or mention TCPA. Just be a friendly potential customer gathering info. They'll tell you everything.
